There are two critical renewal periods for trademarks:
- Between the 5th and 6th years, you must file a Section 8 & 15 declaration. This includes a declaration of use and a declaration of incontestability, which solidifies your rights and makes it harder for others to challenge your mark.
- Between the 9th and 10th year, you’ll need to file a Section 8 & 9 declaration, which again confirms you’re still using the mark.
From there, renewals are required every ten years. If you miss these deadlines, your trademark may be abandoned, putting your brand at risk.
